Our general conditions apply to all our transactions and sales.

1. General

1.1 On all our items the following delivery and payment conditions apply.

1.2 Reservation of items for up to 7 days. If after this period no payment is received the reservation of the article is undone. The article is then placed in the store.

1.3 The sale of an article comes after acceptance of the order and the confirmation via email.

1.4 Dutch law applies to all agreements and disputes between the parties.

2. Prices

2.1 All prices are quoted in euros () and include 21% VAT.

2.2 Prices do not include shipping costs and any costs payable upon receipt.

2.3 The goods remain the property of Rosa Fashion Outlet until the full amount has been paid.

2.4 The prices listed at the time of ordering are binding.

2.5 Rosa Fashion Outlet is not liable for typing, typesetting and printing errors which unintentional could result in a wrong communicated price. If this occurs the price will be adjusted by Rosa Fashion Outlet.

3. Payment

3.1 After ordering you will receive an email confirmation. In this e-mail the total costs are listed. You can pay by:

3.2 Secure online payment through Payment Service Provider ICEPAY.
ICEPAY Payment Service Provider makes it possible for merchants to offer various online payment methods such as iDEAL and PayPal in their shop. As a consumer you can make in a convenient way secure online payments. ICEPAY is solely responsible for the processing of your payment and will not affect the delivery of online purchases.

3.2.1 IDEAL Netherlands only.
3.2.2 PayPal. Worldwide.
3.2.3 Visa. Worldwide.
3.2.5 Wire Transfer. Worldwide. The order will be shipped as soon as the amount is credited to our account.
3.2.6 Bancontact / Mister Cash Belgian customers only.
3.2.7 GiroPay German customers only.
3.2.8 EPS Austrian customers only.

3.3 Postpay with AfterPay. This option is only available to customers in the Netherlands.

If your payment is received by us, we will ship your order as soon as possible. We strive to ship your item(s) within 3 working days with our carrier PostNL.

4. Shipping costs

5. Delivery

5.1 All items are ready for shipment by our carrier PostNL within 5 working days after receipt of payment unless otherwise stated on the website.

5.2 For items with a longer delivery time than 5 days the buyer will be notified by e-mail. The maximum delivery time is 30 days after receipt of payment. If the delivery time is longer than 30 days, the buyer has the right to cancel the agreement. For this, no fee will be charged.

5.3 All offers listed on our website are valid up to the stated expiration date, but may be terminated early by the seller. The offers are valid while stocks last.

5.4 The shipment is made according to the General Conditions for Freight of PostNL, which can be read on Terms as stated by PostNL.

5.5 If items unfortunately are not available, this will be notified by email. The buyer has the option to cancel the order or substitute items to order, for the same order amount.

6. Termination

6.1 If a buyer does not cancel the order within 14 days, see below 1.2, the buyer is obliged to pay. The seller is entitled to calculate reservation costs to the buyer if the order will be canceled after a period of 14 days or if the order is not payed within 14 days.

6.2 The seller can without giving reasons cancel an order or refuse a buyer.

6.3. Every order can only be canceled via email within 14 days after the order date.

7. Cooling off period

Upon receipt of the items ordered by the buyer, the buyer has the right to return the items within 14 days after the date of dispatch. Upon receipt of the returned goods the amount of goods will be refunded within 10 days to the account where the customer has paid the order with. This right does not apply if:

7.1 clothing is worn and / or washed;

7.2 the buyer has tried to repair a defect;

7.3 loss of attachment of the labels. The buyer is responsible for the return. Rosa Fashion Outlet assumes that the buyer returns the item in the same manner, and ensures sending where needed. Franco and COD shipments are never accepted by Rosa Fashion Outlet.

8. Warranty and liability

8.1 Rosa Fashion Outlet guarantees that the delivered items are genuine and comply with the specifications stated in the offer. Color variations can not be ruled out because the color of our items are displayed differently on the basis of the monitor settings and capacities of the (potential) buyer.

8.2 Upon receipt, you are obliged to inspect the goods carefully for any defects.

8.3 Rosa Fashion Outlet does not warrant for defects caused by improper use or lack of care, or that result from changes made by the consumer or a third party after the delivery of the items.

8.4 Rosa Fashion Outlet is not liable for any damage, direct or indirect, after delivery, by whatever cause, has arisen to the buyer at the buyer's business, the buyer or his family, to third parties or of third parties. In particular, the seller is not liable for any loss or damage of shipped items. If it is established that the seller would still be liable for any damage, liability is capped to the amount of the order and never more than € 1,000 in total.
Rosa Fashion Outlet is not liable for the non-permanent availability of www.rosafashionoutlet.com and www.rosafashion.nl and for technical or electronic errors of the online offers.

9. Privacy

All personal information is solely used by Rosa Fashion Outlet and will never be made available to third parties unless necessary for payment transactions and delivery of the order.
